Based on the positivist school theory, explain what change could have prevented this crime from happening. (300–350 words)

Theories and The Prevention of Crimes
My comparison between of positivist and classical school of criminal theory. When it comes to the classical theory which was founded by Cesare Beccaria around the late 18th century his proposal with this theory is the eye for an eye punishment when it comes to criminal behavior. The classical theory is something that is being operated today. Unlike the classical theory in the positivist theory which was founded in the around the 19th century by Lombroso who stated and asserted that criminal behavior is something that is either inherited. The criminal’s behavior had a root cause that was link to criminal activity (Justice, 2017).
Law’s today is persuaded on the classical school theory. The first law that is based on classical as a deterrent for future crimes is the three strikes law. The purpose of this law is to prevent a felon that has been convicted of felonies from preventing future serious felonies the consequence of breaking this is that once the person has committed three felonies that they will be sentence to life in prison without any other alternatives (2019).
In the State of Florida they have a law that if you commit a felony and while committing the felony you use a firearm the person will be sentence according to the law that is known as the “10, 20, life law” . If a person is convicted of a felony where it did involve a firearm that was used or just to attempt to use one will result in a sentence of 10,20 or life but the sentence is slightly different with the use of an assault rifle the sentence will be 15,25 or life (Meltzer, 2020).
The crime that I selected to talk about happened in Polk county Florida where three men were murdered as they went on a fishing trip (Ellenbogen, 2020). The three men were beaten and shot as they arrived at their destination to go on their usual night fishing trip. Based on classical theory the thing that could have prevented this crime is that the punishment was a swift punishment and not something that could be as far as 20 years or so off. The fear of facing a possible death sentence that could be carried out as soon as the next day that the sentence was handed down will deter a lot of crimes from happening. Now based on the positivist theory if they would take the fact that the offender had over three hundred felonies those characteristics should have shown them that one day it was going to lead to something even bigger. The offender should not even have the opportunity to even be on the street with that many felonies he is what is labeled as a habitual offender or career criminal.
